Lodi Area Neighbors Alliance

Members of the Lodi community have formed the Lodi Area Neighbors Alliance (LANA) focused on pursuing a lawsuit against Toll Brothers for disregarding a neighbor’s legal easement and siting a wastewater treatment plant to discharge onto her property.

LANA will also contest a number of permits that EGLE, our state environmental agency, issued to Toll Brothers in connection with their Arbor Preserve developments. Two permits allow private sewage treatment plants to discharge into the Rouse Drain. Another permit allows extensive damage to wetlands and to the Rouse Drain itself. 

The wastewater treatment plants Toll Brothers plans to use have a high failure rate due to poor operator performance and inadequate accident-prevention features and the EGLE permits allow raw sewage to be discharged under certain conditions. That sewage would flow into the Rouse Drain which is often dry under normal conditions.

LANA is currently fundraising to pay the lawyers and experts who are needed to pursue the actions against Toll Brothers and EGLE. Our first court date was on August 5 at the County Courthouse in Ann Arbor. The results were encouraging. The judge issued a temporary restraining order to keep Toll Brothers from building on their neighbor’s easement.
